The High Court ruled that a Muslim man's second marriage is only permissible if he can treat all wives with justice and equality, as the Quran requires, not an absolute right.

The Allahabad High Court criticized the misuse of polygamy under Muslim personal law, stating the Quran's conditional allowance is being used for selfish purposes, contrary to its original intent and spirit.

The court noted polygamy was historically allowed to support widows and orphans after wars, but modern interpretations often ignore its conditional and humanitarian nature, deviating from its original purpose.

The Court aligned its view with the Supreme Court's recommendations in notable cases, stressing the need for a Uniform Civil Code as per Article 44 of the Constitution's vision for uniformity.

The court clarified the legal position on multiple marriages by a Muslim male and their implications under the IPC, specifying situations where such marriages may attract the offence of bigamy.
